Terms of Service

The rules of the road.

Plain-English summary: when you place an order, it is a request that I have to confirm. I will reach out to lock in the date and payment. If anything ever needs to change, just tell me. I run this myself out of a home kitchen.

About these terms

By using this website or placing an order, you agree to these terms. Throughout, “I,” “me,” and “Who Let Her Bake” mean Jessikah Fechner doing business as Who Let Her Bake, a California Cottage Food Operation based in Oakland, CA. “You” means the person placing the order or using the site.

Orders are requests, not guarantees

When you submit an order through this site, you are sending me a request. I review every order personally. Once I have confirmed it (by email and updated status in your account record), the order is final and I will bake it for the agreed date.

I bake on a set schedule rather than to order, so please place online orders at least a week ahead. Your order goes into the next scheduled bake.

I reserve the right to decline any order, including if the requested items are sold out, the delivery address is outside my service area, the requested date does not fit my baking schedule, or for any other reason. If I cannot fulfill a request, I will let you know promptly and there is no charge.

Pricing

Prices for each item are shown on the menu. Local delivery is a flat $4.99 fee, and free on orders over $40 (subtotal before delivery). Pickup is always free, and subscription orders include free delivery as part of the service.

Prices may change occasionally as ingredient costs change. The price you see at the time you place an order is the price you pay for that order, assuming I confirm it.

Under current California law, most cottage food items (including bread and pastries) are not subject to sales tax. If sales tax ever applies to a future product, it will be shown on your confirmed order.

Payment

I accept credit card, cash, Venmo, and Zelle. Payment is due before delivery or pickup unless we agree otherwise.

For credit card payments, I will reach out to take payment securely; I do not store card numbers on this site. For Venmo or Zelle, I will share my handle when your order is confirmed.

Cancellations and changes

Plans change, and I try to be reasonable. Because I bake in scheduled batches, timing is what matters:

  • Up until a few days before your bake date (before I mix your batch): change or cancel freely, just let me know.
  • Once your batch dough is mixed: I usually cannot change what is in it, since the dough is already committed for that bake. Reach out anyway and I will do what I can.
  • After it is baked: it is baked. I will always try to be fair and find a solution.

Allergens and ingredients

Important: my kitchen is not allergen-free. I work with wheat flour, eggs, dairy, and other common allergens on a regular basis. Cross-contamination is possible even on products that do not contain those ingredients.

If you have a serious food allergy, please reach out before ordering. I am happy to walk through ingredients and the kitchen environment so you can make an informed decision. For severe allergies (especially celiac disease, severe wheat or nut allergies), I cannot guarantee a safe product from a home kitchen that uses these ingredients.

Delivery and pickup

Local delivery currently covers Alameda and Oakland on baking days. Delivery is same day as baked when possible. If you are outside that area, choose pickup or reach out and we will work out an arrangement that makes sense (markets, special events, etc.).

For delivery: please be available to receive your order. If no one is home, I will leave it in a safe spot you tell me about in your order notes, or coordinate a redelivery. Once I have delivered to the address you provided, I am not responsible for what happens after.

For pickup: I will reach out with the exact time and location.

Cottage food disclosure

Who Let Her Bake operates under the California Homemade Food Act as a Class A Cottage Food Operation. This means my food is made in a private home kitchen that is not inspected by a public health agency. See the compliance page for more details, including my permit number and the categories of food I am permitted to sell.

Limitation of liability

To the extent permitted by California law, my total liability for any claim related to an order is limited to the amount you paid for that order. I am not liable for indirect, incidental, or consequential damages.

Nothing in these terms limits liability that cannot be limited under California law, including liability for gross negligence or willful misconduct.

Governing law

These terms are governed by the laws of the State of California, without regard to its conflict of law principles. Any dispute will be resolved in the state or federal courts located in Alameda County, California.

Changes to these terms

If I update these terms, the “Effective” date at the top of the page will change. Orders placed before an update are governed by the terms in effect at the time you placed them.
